1. Agreement to Terms
By accessing or using Workely.AI ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Description of Service
Workely.AI provides an AI workforce platform that deploys, manages, and orchestrates AI agents across business functions including sales, support, marketing, operations, and voice. The platform includes a dashboard, analytics, integrations, and automated workflows.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Third-Party Integrations
The Service allows you to connect third-party applications (e.g., Gmail, Salesforce, Slack). By connecting these services, you authorize Workely.AI to access and use data from these services as necessary to provide AI agent functionality. We access only the data necessary via OAuth and do not store third-party credentials.
5. Acceptable Use
You agree not to use the Service to: violate any laws, send spam or unsolicited communications, transmit malicious code, attempt to gain unauthorized access, or use AI agents in ways that could harm individuals or organizations.
6. Payment Terms
Paid plans are billed monthly or annually as selected. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice. Downgrades take effect at the end of the current billing cycle.
7. Intellectual Property
The Service, including all software, algorithms, designs, and documentation, is the intellectual property of Workely.AI. You retain all rights to your data. We do not claim ownership over content you provide to the Service.
8. Data & Privacy
Your use of the Service is subject to our Privacy Policy. We use your data solely to provide and improve the Service. We do not sell your data or use it to train external AI models.
9. AI-Generated Content
AI agents may generate content, responses, and actions on your behalf. While we strive for accuracy, Workely.AI does not guarantee the accuracy of AI-generated output. You are responsible for reviewing and approving agent actions as appropriate.
10. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. Enterprise plans include custom SLA agreements.
11. Limitation of Liability
To the maximum extent permitted by law, Workely.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Workely.AI from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease and your data will be retained for 30 days before deletion, unless you request earlier deletion.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.
